Terms of Service

1. Acceptance of Terms

By accessing and using TeHyBug, you accept and agree to be bound by the terms and provision of this agreement.

2. Use License

Permission is granted to temporarily use TeHyBug for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose
• Attempt to decompile or reverse engineer any software contained on TeHyBug
• Remove any copyright or other proprietary notations from the materials

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding the password and for all activities that occur under your account.

4. Device Data

You retain all rights to data collected by your TeHyBug devices. We store this data securely and will not share it with third parties without your explicit consent.

Sensor readings, alerts, charts and any data shown through the service are provided for general informational purposes only. They may be inaccurate, incomplete, delayed, interrupted or unavailable, and must not be relied upon as a sole or authoritative source of information.

5. Prohibited Uses

You may not use TeHyBug:

• In any way that violates any applicable law or regulation
• To transmit any malicious code or viruses
• To attempt to gain unauthorized access to other users' accounts or devices
• To interfere with or disrupt the service

6. Disclaimer of Warranties

TeHyBug, including its website, software, firmware, devices, data and any related services, is provided "as is" and "as available", with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, TeHyBug and its owner, operators, suppliers and contributors disclaim all warranties, whether express, implied, statutory or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, title and non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure, error-free, or that any data, readings, alerts or notifications will be accurate, complete or delivered.

7. No Reliance — Not for Critical Use

TeHyBug devices and data are intended for general, non-critical, informational and hobbyist use only. They are not designed, intended or authorised for use in any situation where failure, inaccuracy, delay or unavailability could lead to death, personal injury, or physical, environmental, property or financial damage.

You must not rely on TeHyBug for, and you agree not to use it in connection with, any safety-critical, life-support, medical, security, fire/gas/flood detection, environmental compliance, industrial-control or other critical application. You are solely responsible for any decisions or actions taken based on the service, and you assume all associated risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TeHyBug, its owner, operators, employees, suppliers, partners or contributors be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, profits, revenue, goodwill, business, or for any property damage or personal injury, arising out of or in connection with your use of (or inability to use) the service, the devices, or any data or readings, even if advised of the possibility of such damages and regardless of the legal theory.

To the maximum extent permitted by applicable law, the total aggregate liability of TeHyBug for all claims relating to the service shall not exceed the greater of (a) the total amount you actually paid to us for the specific product or service giving rise to the claim in the twelve (12) months preceding the event, or (b) fifty euros (€50).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnification

You agree to indemnify, defend and hold harmless TeHyBug, its owner, operators, suppliers and contributors from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to your use of the service or devices, your data, your violation of these Terms, or your violation of any rights of a third party or any law.

10. Service Availability

The service is provided without any guarantee of availability or uptime. We may modify, suspend, limit or discontinue all or part of the service (including data ingestion, storage, alerts and APIs) at any time, with or without notice, and we are not liable to you or any third party for doing so.

11. Third-Party Services

The service may rely on or link to third-party services (for example messaging, payment, hosting or marketplace providers). We are not responsible for, and disclaim all liability arising from, any third-party services, their availability, content, or their handling of your information, which are governed by their own terms and policies.

12. Governing Law

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-law provisions, except where mandatory consumer-protection laws of your country of residence apply. Any disputes shall be subject to the exclusive jurisdiction of the competent courts, to the extent permitted by applicable law.

13. Modifications

TeHyBug may revise these Terms at any time without prior notice. By continuing to use the service after changes are posted, you agree to be bound by the then-current version of these Terms.
